MaybeReal - Terms of Use
1. Who we are
The MaybeReal mobile application (the "App") is published and operated by Cerebri Virtual Corporation, a French société par actions simplifiée ("we", "us", "our").
- Registered office: 60 rue François 1er, 75008 Paris, France
- Registered in France under number 100 370 469, RCS Paris (EUID FR7501.100370469)
- Intra-EU VAT number: FR42100370469
- Contact: support@maybereal.app
These Terms of Use (the "Terms") govern your access to and use of the App. By downloading, accessing or using the App, you agree to be bound by them. If you do not agree, do not use the App.
2. What the App does, and what the words mean
MaybeReal lets you upload photos and videos and apply AI-powered transformations, including character and style transformations, filters, effects and humorous or "prank" style edits, and lets you generate images and short videos from prompts.
Outputs are produced by automated systems. They are synthetic. They may be inaccurate, unexpected, unflattering, or different from what you asked for. Available features, models and processing times may change, and we may add, modify or discontinue features at any time. Where a change materially reduces what a paid plan offers, section 17 applies.
In these Terms:
- Input Content means the photos, videos, prompts and other material you upload or submit to the App.
- Output Content means the images, videos and other results the App returns to you.
- Content means Input Content and Output Content together.
- Credits means the in-app units consumed when you run a feature. They are granted with a subscription or bought in a pack. They are not money, carry no cash value, and cannot be transferred, sold or exchanged.
- Fair Use Policy means the reasonable limits we apply to keep the service stable and available and to manage the computing cost of generative AI: rate limits, caps on resource-intensive features, and credit requirements for premium models.
- Services means the App and everything provided through it.
3. Eligibility
You must be at least 13 years old to use the App, which is rated 13+ on the App Store and for a comparable audience on Google Play.
Some countries set a higher age, either for entering into a contract of this kind or for an online service to process a young person's personal data without a parent being involved. Across the European Union that age ranges from 13 to 16. Where the law that applies to you sets an age above 13, you must have reached it, or your parent or legal guardian must consent on your behalf and accept these Terms with you.
Some features generate or alter a realistic likeness of a person. Because of what those outputs can be used for, you must have reached the age of legal majority in your country to use them.
By using the App you confirm that you meet these requirements. If we become aware that a user does not, we may suspend or close the account.
4. Account and security
- You are responsible for keeping your credentials confidential.
- You are responsible for activity carried out under your account.
- Tell us immediately at support@maybereal.app if you suspect unauthorised access.
- One person, one account. Accounts may not be sold, shared or transferred.
5. Your content
5.1 Ownership
"Content" means the images, videos, prompts and other material you upload to or generate in the App. You remain the owner of your Content, subject to the rights of any third party appearing in it.
5.2 Licence you grant us
You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display your Content strictly as necessary to operate the App and deliver the features you request, including sending it to the AI service providers listed in section 8. This licence ends when your Content is deleted, except for copies we must retain to comply with law or to handle a dispute, and except for copies held by third-party providers under their own retention rules.
We do not claim ownership of your Content. We do not use your Content in our marketing without your separate, explicit and revocable consent.
5.3 People appearing in your Content
This section matters more than any other in these Terms. You represent and warrant that, for every identifiable person appearing in Content you upload:
- you hold all necessary rights, permissions and consents, including consent to have their image altered, transformed or used to generate synthetic content;
- where that person is a minor, you are their parent or legal guardian, or you hold the documented consent of one;
- you will obtain any additional consent required by the law applicable to you, in writing where that law so requires.
Uploading a photograph of another person may involve processing their personal data, and in some jurisdictions their biometric data. Where you upload Content depicting other people, you act as the controller of that processing and you are responsible for having a lawful basis for it. We process that Content on your instruction in order to deliver the feature you requested.
6. Acceptable use
You agree not to use the App to create, upload, store or distribute anything that:
- is illegal, harmful, abusive, harassing, defamatory, hateful or discriminatory;
- sexualises a minor in any way, or depicts a minor in a sexual, suggestive or degrading context. We report such content to the competent authorities and permanently close the account;
- is sexually explicit, or depicts nudity of a real identifiable person without their consent;
- depicts a real identifiable person in a false, humiliating, defamatory or damaging situation, or in a way likely to be taken as genuine to their detriment;
- impersonates a real person in order to obtain money, credentials, personal data or an advantage;
- fabricates statements, endorsements or conduct by public figures, candidates, officials or institutions in a way capable of misleading the public;
- depicts real violence, self-harm, or promotes any of them;
- infringes the intellectual property, privacy, image or publicity rights of others.
You also agree not to reverse engineer, decompile or extract the source code of the App, not to circumvent technical or security measures, not to scrape or automate access, not to resell or redistribute App outputs as a competing service, and not to manipulate the credit system, including by exploiting subscription changes, refunds, trial resets or multiple accounts.
6.1 Labelling synthetic content
Content generated by the App is artificially generated or manipulated. If you publish or share it, you must not present it as a genuine recording of real events or of a real person's words or conduct, and you must disclose its artificial nature where a reasonable viewer could otherwise be misled or where applicable law, including EU rules on the transparency of AI-generated content, requires that disclosure. Humour does not remove that obligation.
We may apply visible or machine-readable markings to outputs. You must not remove, alter or obscure them.
6.2 Generative AI safety constraints
Because the App generates realistic synthetic media, you additionally warrant that you will not use it to:
- generate or spread information you know to be false, with the intent to harm, deceive, defraud or discredit anyone;
- generate, compile or distribute personal data about someone in order to harass, intimidate, stalk, locate, dox or blackmail them;
- produce content targeting a specific person repeatedly, or content designed to be sent to a person who has asked you to stop;
- create synthetic media of a person in order to gain access to an account, a service, a payment or a benefit in their name, including any attempt to defeat identity or biometric verification;
- give medical, legal, financial or other regulated advice through outputs generated by the App, or present such outputs as coming from a qualified professional;
- feed outputs into automated decision-making that affects a person's legal rights or similarly significant interests.
A prank framing does not exempt any of the above. Whether something is a joke is judged by its effect on the person depicted or targeted, not by your intention.
6.3 Enforcement
We may monitor use of the App to prevent systemic abuse, block prohibited or unlawful uploads and outputs, and keep the service technically stable. We do not pre-screen all Content, and we do not undertake to detect every breach of these Terms. Nothing in this section creates an obligation on us to monitor, and not acting on one breach does not waive our right to act on another.
We may remove Content, and suspend or terminate your access, where we reasonably believe these Terms have been breached. Where the breach is not serious and can be corrected, we will give you notice and an opportunity to correct it first. Section 16 explains what happens to credits.
7. Intellectual property
The App, its design, interface, features and underlying software belong to us or our licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the App. Rights in your Input Content are dealt with in section 5.
Subject to your compliance with these Terms, we assign to you all rights we may have in the Output Content generated for you.
7.1 Commercial use
If you hold an active paid subscription, you may use Output Content for commercial purposes, including marketing, advertising and promotion, provided you comply with section 5.3 and section 6.
If you are on a free or trial tier, your use of the App and of Output Content must be personal and non-commercial.
Where you use Output Content commercially, you are responsible for the consequences of that use, and you will cover us for any third-party claim that results from it, including claims about the rights of people appearing in the Content. This does not apply to loss caused by our own breach of these Terms, and it does not affect your rights as a consumer.
7.2 Watermarks
Output Content generated on a free tier may carry a MaybeReal watermark. You may not remove, crop, mask or otherwise defeat it without an active paid subscription.
7.3 Copyright complaints
If you believe Content in the App infringes your copyright, write to support@maybereal.app with enough detail to identify the work and the material complained of, your contact details, and a statement that you are the rights holder or authorised to act for them. We remove infringing material when a complaint is substantiated.
8. Third-party services
The App relies on third-party providers for hosting, storage, subscription management and AI processing. Some of them operate outside the European Economic Area, and your Content is sent to AI providers in order to produce the outputs you request.
The current list of those providers, together with the purposes, the transfer safeguards and the retention periods, is set out in our Privacy Policy, which forms part of your agreement with us. Read it before uploading Content. Your use of the App may also be subject to those providers' own terms.
9. Subscriptions, credits and purchases
9.1 Plans
The App offers the following auto-renewing subscriptions. Prices are shown in the App before purchase and vary by region.
| Plan | Credits | Credits granted | Renews |
|---|---|---|---|
| MaybeReal Pro | 3,000 | Every 7 days | Every 7 days |
| MaybeReal Pro Plus | 7,000 | Every 7 days | Every 7 days |
| MaybeReal Pro Yearly | 3,000 per month, in 12 successive monthly allocations | Every month for 12 months | Every 12 months |
| MaybeReal Pro Plus Yearly | 7,000 per month, in 12 successive monthly allocations | Every month for 12 months | Every 12 months |
We may also run promotional, limited-time or regional offers, including discounted plans and discounted credit packs, under names not listed above. These Terms apply to them in full, including sections 10 and 11.
On the yearly plans, the price covers twelve monthly credit allocations. Credits are made available one month at a time and are not all released at the start of the year.
9.2 How subscription credits work
- Subscription credits are granted for the current allocation period only: the week on weekly plans, the month on yearly plans.
- At each new allocation, your subscription credit balance is reset to the plan amount. Subscription credits are not cumulative and do not carry over, however many are left.
- Unused subscription credits are forfeited at each allocation.
- Subscription credits cannot be transferred, sold or exchanged for money.
- This non-carry-over rule applies to subscription credits only. Credits from credit packs and in-app rewards are separate: they do not expire and are not reset (section 9.6).
- Where a request fails for a technical reason on our side, the credits consumed are restored.
9.3 Billing
Purchases are processed by the store you downloaded the App from, acting as merchant of record.
Apple App Store. Payment is charged to your Apple Account at confirmation of purchase. Your account is charged for renewal within 24 hours before the end of the current period.
Google Play. Payment is charged to the payment method on your Google Account at confirmation of purchase. Your account is charged for renewal at the start of each new period.
We never receive or store your card or payment details. Subscriptions renew automatically at the then-current price until cancelled.
9.4 Cancelling
You may cancel at any time, without giving a reason. Cancellation stops future renewals. It does not, by itself, refund the current period: see sections 10 and 11.
- iPhone or iPad: Settings, then your name, then Subscriptions, then MaybeReal, then Cancel Subscription.
- Android: Google Play Store, then your profile picture, then Payments and subscriptions, then Subscriptions, then MaybeReal, then Cancel subscription.
- Any device, via the web: play.google.com/store/account/subscriptions for Google Play purchases.
To take effect before the next renewal, cancellation must be made at least 24 hours before the end of the current period. Deleting the App does not cancel a subscription. You keep access to paid features until the end of the period already paid for.
The App also provides a direct link to the relevant cancellation screen in its settings.
9.5 Free trial
MaybeReal Pro includes a 3-day free trial with 300 credits for new subscribers.
- The trial converts automatically into a paid subscription at the end of the 3 days unless you cancel at least 24 hours before it ends.
- Any unused part of a trial is forfeited if you purchase a subscription before it ends.
- One trial per Apple Account or Google Account, as applicable.
9.6 Credit packs
The App offers one-time credit packs in several sizes. The number of credits in each pack, and its price, are shown in the App before you confirm the purchase, and those are the figures that apply to your purchase. Pack credits are delivered immediately on purchase, do not expire, are not reset at renewal, and cannot be transferred. Section 10 explains how the right of withdrawal applies to them.
9.7 Price changes
We may change the price of a plan. A change never applies to a period already paid for: it can only affect a future renewal.
Price increases for existing subscribers are handled by the store, under its own rules. Apple and Google notify affected subscribers in advance, and above certain thresholds, or where local law requires it, the increase applies only if the subscriber accepts it. If a subscriber does not accept it, the subscription simply does not renew at the higher price. You can also cancel at any time, as described in section 9.4.
9.8 Credit cost of features
Features consume different numbers of credits, and more demanding features cost more. The credit cost of a feature is shown in the App before you run it, and that displayed cost is the one that applies to that use.
These costs are not fixed for the life of your subscription. They follow the cost and the capability of the underlying AI models, which change over time. What your plan entitles you to is the credit allocation described in section 9.1, not a fixed number of generations, images or videos.
9.9 Fair Use Policy
All plans are subject to the Fair Use Policy defined in section 2. We may apply rate limits, cap or meter resource-intensive features, and require credits for premium models, in order to keep the service stable and to manage its computing cost. Current limits are shown in the App.
9.10 Platform separation
Subscriptions and credits are tied to the store account used to buy them. Credits bought or granted on iOS cannot be used on Android, and the reverse. A subscription bought on one store is managed and cancelled on that store only.
10. Right of withdrawal
If you are a consumer resident in the European Economic Area or the United Kingdom, you have a statutory right of withdrawal, which you may exercise within 14 days of signing up for or upgrading to a subscription, or of buying a credit pack.
Purchases made through the App Store or Google Play are made through that store, and the right is exercised with the store, under its own rules and through its own channels. Section 11 says where to go.
Where a subscription begins with a free trial, the 14 days run from the moment you sign up for the trial, not from the first charge.
11. Cancellations and refunds
All subscriptions, credit packs and other in-app purchases are sold through the App Store or Google Play. Payment, billing, cancellation and refunds for those purchases are handled by the store operator, under its own policies. Requests must be made to them.
- App Store: reportaproblem.apple.com, or Settings, then your name, then Subscriptions.
- Google Play: play.google.com/store/account, then Payments and subscriptions, then Budget and order history, then Report a problem on the relevant order.
If you were charged after cancelling, or charged twice for the same period, write to support@maybereal.app with your order number and we will look into it.
Outside your statutory rights, we do not refund subscription periods already started or credits already consumed. Nothing in this section limits the rights described in sections 10 and 12.
12. Legal guarantee of conformity
We are liable for any lack of conformity of the digital content and digital services under the applicable consumer law, including, for consumers in France, the garantie légale de conformité provided by the French Consumer Code. That guarantee is free of charge and independent of any commercial guarantee. If the App does not conform, you may require it to be brought into conformity and, in the cases provided by law, obtain a price reduction or terminate the contract with a refund. Consumers resident elsewhere in the EEA or the UK have equivalent rights under their own law.
13. Availability
The App is provided on an "as is" and "as available" basis. We do not guarantee that it will be uninterrupted, error-free, or that any particular output will meet your expectations. We exclude implied warranties to the fullest extent the law allows, but nothing here removes the guarantee in section 12 or any other right you have as a consumer that cannot be waived.
14. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, or loss of data, arising from your use of the App.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any liability that cannot lawfully be excluded or limited. If you are a consumer, we are liable for foreseeable loss caused by our failure to meet these Terms, and the exclusions above apply only so far as your national consumer law permits.
Subject to the paragraph above, our total liability for all claims arising from your use of the App will not exceed the total amount you paid us in the twelve months before the claim arose.
You are responsible for how you use the outputs you generate, including any consequence of publishing them.
15. Personal data
How we collect and process personal data is described in our Privacy Policy. Where you upload Content depicting other people, section 5.3 applies.
16. Suspension and termination
You may stop using the App and delete your account at any time. Deleting your account does not cancel a subscription: cancel it through the store, as described in section 9.4.
We may suspend or terminate your access where you seriously breach these Terms, or where your use may cause harm to us, to other users or to third parties. Except where the breach is serious or unlawful, we will give you notice and a chance to put it right first.
If we terminate your access for a breach, unused subscription credits and unused pack credits are forfeited, and no refund is due for the remainder of the period. If we terminate your access without you having breached these Terms, we refund the unused part of the period on a pro rata basis. You can contest a termination by writing to us, and section 18 remains available to you.
17. Changes to these Terms
We may update these Terms. Where a change is material, or reduces what a paid plan offers, we will notify you at least 30 days in advance, in the App or by email. The change applies to you from the start of your next billing period. If you do not accept it, you may cancel before it takes effect, and where the change materially reduces a plan you have already paid for, you may terminate and receive a pro rata refund for the unused part.
18. Governing law, complaints and disputes
These Terms are governed by French law.
If you are a consumer resident in the European Union, the EEA or the United Kingdom, this choice does not deprive you of the protection of the mandatory rules of your country of residence, and you may bring proceedings in the courts of that country.
Complaints. Write to us first at support@maybereal.app. We aim to answer within 5 working days.
Cross-border disputes. Consumers resident in the EU can also contact the European Consumer Centre in their country.
19. Miscellaneous
If any provision of these Terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, form the whole agreement between us regarding the App.
These Terms are drafted in English. Where we provide a translation and a discrepancy arises, the English version prevails, except where the law applicable to you as a consumer provides otherwise.
